监理人的义务
Obligations of the Supervisor
监理人应派出监理工作需要的监理机构及监理人员，向委托人报送委派的总监理工程师及其监理机构主要成员名单，监理规划，完成监理合同专用条件中约定的监理工程范围内的监理业务。在履行本合同义务期间，应按合同约定定期向委托人报告监理工作。
The Supervisor shall designate the Supervision Team and superintendents necessary for carrying out the supervising works; provide to the Client a name-list of the Chief Supervision Engineer, main staff of the Supervision Team and a supervision plan and perform the supervision services within the scope of work as stated in the Conditions of Particular Application. During the execution of the Contract, the Supervisor shall submit supervision report to the Client at regular interval as stated in the Contract.
监理人应按照发包人的授权发出监理指示。监理人的指示应采用书面形式，并经其授权的监理人员签字。紧急情况下，为了保证施工人员的安全或避免工程受损，监理人员可以口头形式发出指示，该指示与书面形式的指示具有同等法律效力，但必须在发出口头指示后24小时内补发书面监理指示，补发的书面监理指示应与口头指示一致。
The supervisor should issue his supervision instructions pursuant to the employer’s authorization. The supervisors instruction shall be in writing and accompanied by the signature of the authorized supervisor thereon. In case of emergency, for the purpose of protection of workers safety and avoidance of damage to the works, the supervisor may issue his oral direction which has equal legal force with the same in writing, however provided that the replaced direction in writing should be issued within 24 hours following issue of oral direction and the contents thereof should be consistent with the oral direction.
监理人发出的指示应送达承包人项目经理或经项目经理授权接收的人员。因监理人未能按合同约定发出指示、指示延误或发出了错误指示而导致承包人费用增加和（或）工期延误的，由发包人承担相应责任。除专用合同条款另有约定外，总监理工程师不应将第4.4款〔商定或确定〕约定应由总监理工程师作出确定的权力授权或委托给其他监理人员。
The instruction given by the supervisor shall be served to the project manager of the contractor or the person authorized by the project manager. The employer shall be liable for the failure of the supervisor pursuant to the agreement of contract to issue the instruction, delay instruction or incorrect instruction, which lead to added cost and or delay in the schedule occurred by the contractor. Unless otherwise specified in the particular condition, the determination power which should be exercised by chief supervise engineer subject to the stipulation of [agreed or determined] in article 4.4 should not be authorized or delegated to other supervisors.
承包人对监理人发出的指示有疑问的，应向监理人提出书面异议，监理人应在48小时内对该指示予以确认、更改或撤销，监理人逾期未回复的，承包人有权拒绝执行上述指示。
For any doubt or question to the supervisor’s instruction the contractor should submit a written objection to the supervisor, for which the supervisor should within 48 hours give confirmation, alteration or rescission of the instruction, if failure to do so, the contractor is entitle to refuse implement of the above instruction.
监理人对承包人的任何工作、工程或其采用的材料和工程设备未在约定的或合理期限内提出意见的，视为批准，但不免除或减轻承包人对该工作、工程、材料、工程设备等应承担的责任和义务。
Provided that if the supervisor fail to submit opinions within a reasonable period of time to the contractor’s any work, engineering or used materials and construction equipment, which deemed to have approved thereto, however, should not discharge or relieve the contractor’s responsibility and obligation related such work, engineering or used materials and construction equipment.
发包人应按照法律规定获得工程施工所需的许可。经发包人同意后，监理人发出的开工通知应符合法律规定。监理人应在计划开工日期7天前向承包人发出开工通知，工期自开工通知中载明的开工日期起算。
The employer shall, in accordance with the stipulations of law, obtain the necessary permission and approval for the construction of the works. The Commencement Notice issued by the supervisor shall, subject to the employer’s approval and comply with the stipulations of law. The supervisor shall, 7 days prior to the scheduled commencement date and the work term will be calculated from the commencement date which is stated in Commencement Notice.
甲方代表： 指本工程监理单位委派的总监理甲方代表或甲方指定的履行本合同的代表，其具体身份和职权由双方在条款中约定。
Party As representative: chief supervision engineer appointed by the supervision enterprise of the project as the representative of Party A or representative appointed by Party A to perform the contract, whose capacity and authority shall be specified in the clause hereunder.
监理单位：指发包人委托的负责本工程监理并取得相应工程监理资质等级证书的单位。
The Supervisor: The company entrusted by the Employer to be responsible for the supervision of this Project, who has obtained the relevant qualification certificate for project supervision.
工程师：指监理单位委派的总监理工程师及发包人指定的咨询单位的驻工地代表，其具体身份和职权由发包人承包人在专用条款中予以约定。
The Engineers: The general supervision engineer appointed by the Supervisor and the on-site representative (which is the designated consultant of the Employer).Their identity and authority will be specified by the Employer and the Contractor in the Particular Terms of the Contract.

监理人应认真，勤奋地工作，在履行合同义务时为委托人提供与其水平相应的咨询意见，公正维护各方的合法权益。
The Supervisor shall exercise reasonable care and diligence, provide advice at an appropriate level in the performance of the obligations under the Contract to the Client and indemnify the lawful rights and interests of various parties.
监理人使用委托人提供的设施和物品属委托人的财产，应恰当使用和维护。在监理工作完成或中止时，应将其设施和剩余的物品完好地移交给委托人。
Any facilities and articles supplied by the Client for use by the Supervisor shall be properly used and maintained and remain the property to the Client . When the services are completed or terminated the Supervisor shall deliver to the Client such facilities and unconsumed articles in good working order.
监理人的职责和权力 Liability and Authority of Supervisor
须经发包人事先批准行使的权力：对本工程项目的施工质量、进度、投资、安全施工、合同及信息管理等实施全过程监理和控制。对隐蔽工程及施工质量进行验收和工程量签认，对施工环境进行协调。
The authority subject to pre-approval of employer: Whole process supervision and control on quality, progress, investment, safe work of this project, in addition to the management of contract and information. The acceptance of hidden works and quality thereof, confirmation of work amount and coordination of engineering environment.
通过委派施工监理工程师对乙方的质量、施工进度和投资规模进行全过程有效的控制。
To delegate supervising engineer for taking effective control on party B’s quality, progress of construction and investment scale during the whole process of project.
业主可聘请一名或多名独立监理工程师，在施工和测试过程中监督并管理工程质量。承包商应服从该等监督管理。业主应书面通知承包商监理工程师的授权范围。除非该等通知明确规定，除了工程质量和安全管理的事宜，监理工程师无权代表业主行事，亦无权调查或处理与工程有关的任何权利主张。
Owner may engage one or more independent Supervision Engineers to supervise and manage the quality of the Work in the course of construction and testing. Contractor shall abide by such supervision and management. Owner will notify the Contractor of the scope of authorization of the Supervision Engineer in writing. Unless expressly stated in such notification, Supervision Engineer shall have no right to act on behalf of the Owner other than with respect to the quality and safety management matters of the Work, nor shall the Supervision Engineer have the right to ascertain or handle any claims relating to the Work.
